A Participant whose Member Association is participating in the Workers' Compensation coverage shall be entitled to the following services:

  • Legal representation in Workers' Compensation proceedings arising from his or her employment as a peace officer for which:

    • The Participant is unable to obtain legal representation on a contingent fee basis; and

    • There is no claim of wage loss; and

    • Either of:

      1. The purpose of the representation is to obtain supportive and medically necessary care after the initial proceeding has been closed; or

      2. The purpose of the representation is to appeal to the Industrial Commission a denial of medical care and treatment for injuries or illnesses which were the subject of proceedings in which a contingent fee was not awarded.

      3. All customary, necessary, and reasonable services directly related to a proceeding as described above.
